By signing up for a DB Delivery membership, you agree to the following terms and conditions (“Terms”) with Double Bay Hardware (Fanllen Pty Ltd). These Terms are between you and Double Bay Hardware and govern our respective rights and obligations. Please note that your use of the doublebayhardware.com.au website and your DB Delivery membership are also governed by Double Bay Hardware User Agreement and all applicable policies on the Double Bay Hardware website, which are incorporated into these Terms.
1. Becoming an DB Delivery member
1.1. You must have a Double Bay Hardware online store account with a registration address in Australia in order to join DB Delivery. Your DB Delivery membership is linked to your Double Bay Hardware online store account.
1.2. To join DB Delivery, you must sign in to your Double Bay Hardware online store account and then complete the purchase process by selecting a payment method, reading and accepting these Terms and then click the “Pay now” button.
1.3. When you click the “Pay now” button, you are entering into a binding agreement between you and Double Bay Hardware, based on these Terms. Double Bay Hardware will send you an email within 24 hours confirming your DB Delivery membership.
1.4. Double Bay Hardware reserves the right to accept or refuse membership in its discretion.
2. Membership cancellation
2.1. You may cancel your DB Delivery membership at any time by selecting “My Membership” on your My Account (after login to your account) page and then selecting the “Cancel next renewal” option in the Status section.
2.2. Other than in the circumstances set out in clause 2.3 below, if you cancel any time after becoming a paid member or your membership automatically renews at the end of your membership term:
2.2.1. You will not be refunded your membership fee regardless of whether or not you made any eligible purchases or have taken advantage of any DB Delivery benefits since your latest membership charge; and
2.2.2. you will continue to receive all DB Delivery benefits until the end of your membership term, but your membership will not be automatically renewed for a further term.
2.3. If your monthly membership or annual membership renews automatically at the end of your membership term and you are charged the annual membership fee, you will have 14 days from the date you have been charged on your preferred payment method to request a refund of the membership fee from contact customer service. For the avoidance of doubt, you will no longer be entitled to the benefits of your DB Delivery membership from the date of cancellation.
3. Benefits of DB Delivery membership
3.1. As an DB Delivery member:
3.1.1. You are entitled to earn DB points when making purchase, ad redeem DB points for discount voucher. Check DB Reward program T&C.
3.1.2. You are entitled to free regular delivery on all physical products which listed on website, excluded product which described "This item can not be posted, in store only." , subject to clauses 3.2, 3.3, 3.4, 3.6 and 3.7;
3.1.3. You are entitled to free returns in 14 days after your order arrived, subject to clauses 3.3, 3.4, 3.5, 3.6 and 3.7;
3.1.4. You are entitled to receive same business day dispatch service, if your order is confirmed by 3PM in business day.
3.1.5. You are entitled to receive 3% off discount of all physical products which listed on website.
3.2. “Free regular delivery” means free standard domestic postage with tracking. We will selected the most suitable delivery service to delivery your order.
3.3. You are only entitled to the benefits set out in clause 3.1 when you purchase products for personal/ domestic rather than business purposes.
3.4. You are only entitled to free regular delivery on a DB Delivery product when:
3.4.1. You purchase and pay for the product online via www.doublebayhardware.com.au; and
3.4.2. You purchase the item using the “Pay now” button in payment page, but not “Buy with Apple Pay” or “But with Google Pay” or “Buy it now” button in product page.
3.5. You are only entitled to return a product for free when:
3.5.1. You have purchased the item using the “Pay now” button in payment page, but not “Buy with Apple Pay” or “But with Google Pay” or “Buy it now” button in product page.
3.5.2. You return the item within 14 days of receipt.
3.5.3. You request the return through online store returns services;
3.6. Double Bay Hardware reserves the right in its sole discretion to change its designated shipping partners or add new shipping partners at any time.
3.7. Double Bay Hardware reserves the right in its sole discretion to add or remove DB Delivery benefits.
4.1. The DB Delivery membership fee is AU $59.99 per year or AU $5.99 per month.
4.2. The membership fee is payable once you sign up for an DB Delivery membership and Double Bay Hardware sends you an email confirming your membership. In the case of a renewal of an existing membership, the membership fee is payable at the beginning of the new membership term.
4.3. You will be automatically charged for the annual or monthly membership fee (as applicable) using the preferred payment method you have selected, unless you cancel your membership prior to the charge. UNLESS YOU CANCEL YOUR MEMBERSHIP, YOU UNDERSTAND THAT YOUR DB DELIVERY MEMBERSHIP WILL AUTOMATICALLY CONTINUE IN ACCORDANCE WITH CLAUSE 5.3 AND YOU AUTHORISE US (WITHOUT NOTICE TO YOU) TO COLLECT THE MEMBERSHIP FEE USING THE PAYMENT METHOD WE HAVE ON FILE FOR YOU.
4.4. If all payment methods Double Bay Hardware has on file for you are declined and your membership fees cannot be paid, you must provide us with a new eligible payment method promptly or your membership will be cancelled.
4.5. You can get an invoice for your DB Delivery membership fees from the My Account page.
5. Term and Termination
5.1. Your DB Delivery membership is valid for 1 year or 1 month as applicable from the date of signing up (“membership term” or “term”).
5.2. Your DB Delivery membership will automatically renew at the end of each membership term for a further term unless you or Double Bay Hardware cancel it prior to the end of the membership period.
5.3. If your original payment method is declined and you subsequently provide us with a new eligible payment method and are successfully charged for your membership fees, your membership will start from the date you signed up or your membership renewal date, not the date of the successful charge.
5.4. Double Bay Hardware reserves the right to terminate your DB Delivery membership at any time in its discretion, without refunding your membership fees where: Double Bay Hardware reasonably considers you are using DB Delivery services to the detriment of Double Bay Hardware and other members; or you fraudulently use the DB Delivery services; or your use of the DB Delivery membership breaches these Terms and Conditions or any applicable law.
Double Bay Hardware will give you prior notice of such termination unless there is a need for Double Bay Hardware to act urgently to prevent loss or damage to Double Bay Hardware or its members, including where your use of your DB Delivery membership has been fraudulent.
5.5. If your DB Delivery membership is terminated for any reason, your DB Delivery membership will also terminate automatically.
6. Limitation of liability
6.1. To the extent permitted by law, Double Bay Hardware will not be liable for any loss incurred by you, or for any costs, damages, accident, delay, technical malfunction, injury, expense or inconvenience that arise as a result of or in connection with your DB Delivery membership.
7. Additional terms
7.1. You may not transfer or assign your DB Delivery membership or any DB Delivery benefits to any another person.
7.2. Double Bay Hardware may, in its sole discretion, assign its rights and obligations under this agreement, either wholly or in part, to another Double Bay Hardware entity or third party
7.3. Double Bay Hardware may amend these Terms at any time by posting the amended terms on www.doublebayhardware.com.au. We will also notify you of any material amendments through message or directly to the email address linked to your account. Except as stated elsewhere, all amended terms will automatically be effective after they are posted. If you do not accept the changes you should cancel your DB Delivery membership in accordance with clause 2.
7.4. If any provision of these terms is held to be invalid or unenforceable, such provision will be severed and the remaining provisions will remain in effect.
Double Bay Hardware Billing Agreement
By putting this bank account, PayPal account, or credit or debit card (as applicable, your “Automatic Payment Method”) on file with us, you agree to the following terms, also referred to as your billing agreement, for our sites, services, applications and tools (the “Services”) on which you transact. The entry of your personal information in the above fields constitutes your intent and consent for its use as an electronic signature, only for this billing agreement.
PARTIES TO THIS BILLING AGREEMENT
You are contracting with Double Bay Hardware (Fanllen Pty Ltd) (individually and collectively referred to as “Double Bay Hardware," "we," or "us") determined by your country of residence.
AUTHORIZATION TO CHARGE YOUR AUTOMATIC PAYMENT METHOD
You authorize Double Bay Hardware to charge your Automatic Payment Method for any and all amounts arising from your use of our Services (collectively, the “Authorized Amounts”). These Authorized Amounts may differ depending on the Service(s) you access and will arise from your activities as you interact with our Services. You understand and reasonably expect that payments made under this billing agreement are for variable amounts and may be made on various dates. As such, Double Bay Hardware may charge your Automatic Payment Method on a one-time, sporadic or recurring basis. An example of a recurring payment from you to Double Bay Hardware is payment of your membership term.
If payment using this Automatic Payment Method cannot be completed for any reason, you authorize Double Bay Hardware to charge other payment methods you have on file for Authorized Amounts under the terms of this billing agreement.
PAYMENT METHODS ON FILE
This Automatic Payment Method will become your preferred payment method on file with Double Bay Hardware for automatic payments of any Authorized Amount. If you have other payment methods on file, we may switch your default payment method to this Automatic Payment Method. You can change your preferred payment method in your account settings.
We may allow you to designate a different payment method for automatic payments of certain Authorized Amounts. If you put another payment method on file with us for this purpose, then we will use that payment method for those designated Authorized Amounts under the terms of this billing agreement.
Your Cancellation Rights: The authorizations in this billing agreement are valid for as long as you use our Service(s) or until you cancel this billing agreement. You can cancel this Agreement by contact us by message or send email to customer service. By cancelling this billing agreement, you agree to cancel your use of our Service(s). You can find instructions to cancel your account within the Help pages in our website.
Cancellation by Double Bay Hardware: This billing agreement may be cancelled by Double Bay Hardware at any time.
A cancellation will not be effective until Double Bay Hardware and your financial institution have a reasonable opportunity to act on it. If this billing agreement is cancelled and you do not cease use of our Services, we may restrict, suspend or terminate your ability to use our Services.
YOUR CONTINUING OBLIGATION
If payment of Authorized Amounts cannot be completed for any reason or this billing agreement is cancelled, you remain obligated to pay Double Bay Hardware for all unpaid amounts and Double Bay Hardware reserves the right to seek reimbursement through other means.
We may provide you with notice prior to charging you for some Authorized Amounts. To the extent possible under applicable law, you waive any rights you may have to receive advance notice of any particular preauthorized charge.
Requests for a refund of any Authorized Amounts are governed by the policies of the Service from which the original charge arose.
Double Bay Hardware may amend this billing agreement at any time on advance notice of no less than 30 days. We will notify you of amendments through the website message and/or by email. If we provide notice of amendments to this billing agreement and you do not wish to continue using the Services under the revised terms, then you may cancel this billing agreement as provided herein and cease using the Services. Your continued use of any of our Services after any such amendment becomes effective will constitute your acceptance of the revised terms.
This billing agreement is governed by the choice of law and dispute resolution provisions as set forth in the User Agreement of the relevant Service.
